SUMMIT One Vanderbilt Sweepstakes Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH FACEBOOK OR INSTAGRAM, AND ANY REFERENCE TO ANY OF SPONSOR’S PRODUCTS, SERVICES, OR OFFERINGS BY TRADE NAME, TRADEMARK, MANUFACTURER, SUPPLIER OR OTHERWISE DOES NOT CONSTITUTE OR IMPLY ENDORSEMENT, SPONSORSHIP OR RECOMMENDATION.

Eligibility: Sweepstakes is open to legal residents of the United States and the District of Columbia, and Canada (excluding Quebec) who are 18 years of age or older as of the date of entry and who have a registered public Instagram account as of date of entry, except employees of Sponsor and its affiliates, subsidiaries, advertising and promotion agencies and the immediate family members and/or those living in the same household of each such employee. Void where restricted or prohibited, and subject to all federal, state, provincial and local laws.

Sweepstakes Period: Sweepstakes begins on August 19th, 2021 at TIME 11:00 AM Eastern Time (“ET”) and ends on August 26th, 2021 at 12:00 AM (the “Sweepstakes Period”). Sponsor shall determine timeliness of entries in its sole discretion.

How to Enter the Sweepstakes: There is NO PURCHASE NECESSARY to participate. A purchase does not increase your chances of winning. During the Sweepstakes Period, you must follow SUMMIT One Vanderbilt on Instagram (username: @summitov). If you do not have an Instagram account, you will need to create one, and it is free to do so. During the Sweepstakes Period, look for the Sweepstakes post on SUMMIT One Vanderbilt’s Instagram feed (the “Sweepstakes Post”) and respond to the Sweepstakes Post with a comment that answers the prompt to receive one (1) eligible entry. In the event, Sponsor does not receive any eligible entries, the Sponsor has the right to cancel the Sweepstakes. Entries must be complete and received before the end of the Sweepstake Period to be eligible for the applicable Sweepstakes prize drawing. An official entry will only be counted if Instagram displays the comment on the public post. Limit one (1) entry per person. Sponsor is not responsible for late, lost, invalid, unintelligible or misdirected entries. Multiple entries are not permitted to share the same Instagram account. Group submissions are not eligible. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different Instagram accounts, identities, registrations and logins, or any other method will void that entrant’s entry and that entrant may be disqualified. In the event of a dispute as to any registration or entry, the authorized account holder of the social media account used to register will be deemed to be the entrant. The “authorized account holder” of the account is the natural person who registered for the profile. The potential winner may be required to show proof of being the authorized account holder, including but not limited to the proof issued by Instagram. ANY ENTRY DEEMED INAPPROPRIATE OR UNSUITABLE, IN SPONSOR’S SOLE DISCRETION, WILL BE DISQUALIFIED. Entries must be original work of entrant; must not contain material that is inappropriate, indecent, contain profanity, nudity, sexual content; hateful content of any kind; content that promotes violence or harm to another living creature; any other offensive content (as determined by Sponsor in its sole discretion); not defame or invade the publicity or privacy rights of any person, living or deceased; infringe, violate, or misappropriate any person’s or entity’s personal or proprietary rights (including copyrights, trademarks, or other intellectual property rights). Failure to comply with these requirements, as determined by Sponsor in its sole discretion, is grounds for an automatic disqualification from the Sweepstakes.

Sweepstakes Random Drawings: One (1) winner(s) will be randomly selected to win a prize during each Sweepstakes based on a random drawing of all eligible entries received during the applicable Sweepstakes Period. All decisions by the sponsor are final. Odds of winning will be determined by the number of eligible entries received. You must be following SUMMIT One Vanderbilt on the social media platform of entry at the time of the drawing to be eligible to win. The winner will be notified by Direct Message on the platform of entry. The prize winner must reply to the winner notification Direct Message from Sponsor and include the email address of the winner within forty-eight (48) hours. If a potential winner is not reachable at the e-mail address provided and a forwarding address and/or e-mail address is not made available or if prize notification is returned as undeliverable, then the prize will be forfeited and an alternate winner may be selected.

For Canadian Residents Only: The potential prize winner must correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered online or by mail, email or phone, as Sponsor determines.

Release: By participating in the Sweepstakes, entrants are solely responsible for their own actions and agree to release, discharge and hold harmless the Sweepstakes Entities and Instagram from any and all claims, liability, costs, losses, damages or injuries of any kind arising in connection with their participation in the Sweepstakes or the award or use of a prize.

Verification of Potential Winners: A potential winner is not a winner, unless and until that person’s eligibility, selection and identity have been so verified and declared by Sponsor, including that such potential winner has been notified and fulfilled the conditions set forth in these Official Rules so that the verification process is complete. Sponsor reserves the right to disqualify any entrant who is found to have failed for any reason to have complied with these Official Rules.

Sweepstakes Prizes: One (1) prize(s) will be awarded during each Sweepstakes with an approximate retail value of $350.00.

Approximate Retail Value of all prizes: $350.00. No cash in lieu of prize will be awarded. No substitution or transfer of prize permitted except at the sole discretion of Sponsor who reserves the right to substitute a prize of equal or greater value. All applicable federal, state, provincial and local taxes are the sole responsibility of the winner.

General Conditions: By participating in this Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of Sponsor. Sponsor is not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error which may occur in the processing of entries in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other problems beyond the control of Sponsor and award prizes from among all eligible entries received prior to cancellation. Sponsor and each of its employees, affiliates, subsidiaries, advertising and promotion agencies will have no liability or responsibility for any claim arising in connection with participation in this Sweepstakes or a prize awarded.

General Rules: Sponsor reserves the right in its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes; violates the Official Rules; or acts in an un-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Winner assumes all liability for any injury or damage caused, or claimed to be caused including computer malfunction, by participation in this Sweepstakes or by use or redemption of any prize or by any related activities. Acceptance of a prize constitutes permission to use winner’s name and likenesses for promotional purposes without further compensation except where prohibited by law. Except as otherwise provided herein for the use of certain winner information, personal information collected from each entrant will only used by Sponsor for the purpose of administration of the Sweepstakes.

Data Protection/Privacy Policy: Information collected by Sponsor in connection with the Sweepstakes is subject to Sponsor’s privacy policy located at https://summitov.com/privacy-policy/ and applicable data protection laws. Each entrant agrees to the collection, processing and storage of entrant’s personal data by Sponsor for purposes of the Sweepstakes.

Jurisdiction: The Sweepstakes shall be governed by and interpreted in accordance with the laws of the State of New York applicable to promotions fully carried out within New York. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' and/or experts’ fees; and winner hereby waives all rights to claim punitive, incidental and consequential damages and any other damages (including attorneys fees), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Each prize winner acknowledges that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce the winner to execute any document and the winner acknowledges that he or she has not executed any document in reliance on any such promise, representation or warranty not contained herein. Any waiver by Sponsor and its affiliates of any term of any document in a particular instance shall not be a waiver of such term for the future. The winner agrees that the invalidity or enforceability of any part of any document shall in no way affect the validity or enforceability of any of the remainder of that document.
